We believe that an amicable resolution is preferred over a trial, since people know their families and individual situations better than the lawyers and the courts. However, people can have a reasonable difference of opinion, requiring a judge to resolve issues. We believe that our clients should be prepared for this contingency, while also trying to work toward an amicable resolution to avoid delays.
There are also situations where spouses/partners are difficult and unreasonable or immediate court intervention is required. A "Plan B" should always be kept in mind — a more aggressive strategy to deal with a difficult and unreasonable party who will not cooperate and participate in the process in good faith, or when immediate court intervention is required. Whether we start with "Plan B" or reserve it for later is a strategic decision that is individual to each client.
